Mediation is a form of alternative dispute resolution resolving disputes between two or more parties. Typically, a third party (the mediator) assists to negotiate a settlement. Disputants may mediate disputes in a variety of areas, such as commercial, legal, diplomatic, workplace, community, and family matters.

Mediation has many significant advantages over traditional lawsuits, such as being quicker, less expensive, less formal, and produces better results. Also, mediation cases are confidential, unlike traditional lawsuits, which are public, and helps preserve the relationship between parties.

While there is no formal process, typically mediations usually see the mediator guide each side through a discussion of the dispute/issue, with each party getting the chance to voice their side, and then help the parties come together to jointly negotiate a solution. If the negotiation is successful, then the mediator will put down the agreement in writing, advise them to consult a lawyer, and ask them to sign pending their lawyer’s agreement.

Mediation is often the best choice for cases that either do not involve large sums of money or do not involve substantial legal issues. These disputes can range from disputes between business partners to arguments between neighbors. Because these disputes can usually be resolved through better communication, mediation can offer a less expensive alternative to court. Also, some states require child custody disputes to go through mediation first.

Susan W. Cox is an experienced litigation and mediation attorney. She is a lifelong resident of Statesboro, Georgia, with extensive civil litigation trial experience. She is active in her community and church, and she has held numerous leadership positions in both community and professional organizations. She has an AV rating with Martindale Hubbell, and she has been named to both the “Super Lawyers” and “Best Law Firms” lists. She is a past participant in Leadership Georgia and is a Fellow in the American College of Trial Lawyers. She is also frequently called on to mediate civil litigation cases and uses her litigation experience in her mediation practice.
